Here's the deal, folks. The government filed for and got an upward departure on SPJ's sentence. That means that they're going to sentence her to MORE TIME than she would have normally gotten under the federal sentencing guidelines. Interesting read, that brief. Apparently the judge also agrees that SPJ is a recidivist - and when the judge agrees with that when determining your sentence, well..that's bad for you.

The IRS is you partner. There are over 120 criminal provisions that make not paying tax a crime. You need to ignore the constitutional analysis of CPAs. You will go to jail, sure as Wesley Snipes, Willy Nelson and James Brown had trouble.

Good post squonkstear. The difference between Snipes and Willy is that Willy fell victim to poor advice and worked very hard to pay what he owed to the IRS. Snipes is pulling shenanigans with not making his required reports to the court. The judge allowed him to travel internationally while he appeals his sentence and I wouldn't be surprised if he never comes back.

Idaho 1996) That's the case where the Courts ruled that the United States and not the IRS is the correct party. It said nothing about the IRS not being part of the US Government. You wouldn't know the correct citation considering you copied your response directly from a TP website.
